It is discusses the legal framework in India that recognizes the right to live in a clean and healthy environment. He emphasizes the need for awareness of the legal provisions related to environmental protection to achieve better results for society. The right to live in a healthy and clean environment is a right. It has been recognized by the Indian legal system and judiciary for over a century. Natural resources such as air, sea, water, and forests are vital to people’s lives. And should be freely available to everyone. The government has a duty to safeguard these resources for the public. Should not allow their use for industrial purposes. The importance of public interest litigations (PIL) in various courts to draw attention to environmental protection. Natural resources being a present of nature, ought to be freely out there to everybody. Regardless of the standing in life The judiciary has managed to increase the ambit of Article 21. Through various judicial pronouncements are there. To include the Right to healthy and clean environment to be a fundamental right under right to life. It also imposes a duty on the state to protect the life and liberty of the people. Although the original constitution contained only a few directives related to public health, agriculture, and animal husbandry, amendments have been added to impose a duty on citizens to protect and conserve the environment. Directive principles of the Indian constitution, such as Article 39(b), Article 47, Article 48, and Article 49, require states to improve the general health level of citizens and protect and improve the natural environment.
